Terms of Service

These Terms of Service (hereinafter referred to as the "Terms") apply to the service "LocPic" (hereinafter referred to as the "Service") provided by Manufac Co., Ltd. (hereinafter referred to as the "Company"). These Terms apply to all users (hereinafter referred to as "Users") who use the Service.

Article 1: General Provisions

Users of the Service shall use the Service in accordance with these Terms. If you do not agree to the Terms, you may not use the Service.

By using the Service, Users are deemed to have agreed to these Terms.

Article 2: Handling of Notifications Other than the Terms

In addition to these Terms, various provisions and notices provided by the Company to Users via the Service or its official website shall constitute part of these Terms at the time of notification, and Users shall accept such provisions.

Article 3: Changes to the Terms

The Company may change these Terms at any time at its discretion.

The amended Terms shall, in principle, become effective at the time they are published on the Service or the official website.

If a User uses the Service after the changes become effective, the User is deemed to have agreed to the amended Terms.

Article 4: User Registration

To begin using the Service, applicants shall agree to these Terms and register as a User by entering the required information prescribed by the Company on the login screen of the Service. User registration must be performed by the applicant themselves. Please ensure that all information entered during registration is accurate.

The Company is not involved in and bears no responsibility for the User's usage environment.

Users shall, at their own responsibility, take security measures such as preventing computer virus infections, unauthorized access, and information leakage.

Article 5: Compliance with Child Safety Standards Policy

In providing the Service, the Company complies with the Child Safety Standards Policy (Google Play Policy).

The Company and Users shall not engage in Child Sexual Abuse and Exploitation (CSAE) in the provision or use of the Service.

The Company complies with all applicable laws and regulations regarding child safety.

Article 6: Handling of Personal Information

The Company will use collected personal information within the scope necessary for operation and management. Additionally, the Company may utilize such data in a non-personally identifiable form for marketing, social contribution, or disclosure to external organizations.

Article 7: User Responsibility

Users shall resolve, at their own responsibility and expense, all claims or demands arising from or related to User Content, the User's use of or connection to the Service, violation of the Terms, or infringement of third-party rights by the User.

If the Company incurs costs or pays compensation in connection with such claims or demands, the User shall bear those costs, compensation, and legal fees incurred by the Company. The Company may claim the total amount from the User.

Users acknowledge that the Company has no obligation to store User Content and shall back up necessary content as appropriate.

The Company does not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any content or communications, nor does it endorse any opinions expressed via the Service.

Article 8: Prohibited Acts

Users shall not engage in the following acts. Violation of these prohibitions may result in restrictions, including access bans:

  1. Infringement of intellectual property rights (copyrights, trademarks, etc.).
  2. Infringement of property, privacy, or portrait rights of others.
  3. Unfair discrimination, slander, or damage to the honor or credit of others.
  4. Falsely representing identity, authority, or affiliation with other persons or organizations.
  5. Acts linked to crimes such as fraud, drug abuse, child prostitution, or illegal trading of bank accounts/mobile phones.
  6. Posting, selling, or advertising information equivalent to obscenity, child pornography, or child abuse.
  7. Using the Service for sexual or obscene purposes.
  8. Using the Service for the purpose of meeting the opposite sex (dating).
  9. Encouraging or inducing runaways by minors.
  10. Engaging in or soliciting participation in illegal gambling.
  11. Undertaking, mediating, or inducing illegal acts.
  12. Inducing or soliciting suicide.
  13. Posting or displaying information depicting or suggesting cruelty (killing, injury, etc.).
  14. Posting personal contact information (address, phone number, email) of oneself or others.
  15. Spamming or similar acts.
  16. Unauthorized modification or deletion of information within the Service.
  17. Sending or utilizing harmful computer programs such as viruses.
  18. Overloading the Service or third-party servers, or interfering with the Service's operation, networks, or systems.
  19. Linking to content while knowing it falls under the above prohibited acts.
  20. Violating laws, public order, morals, or these Terms, or infringing on the rights of others.
  21. Promoting the existence of anti-social forces.
  22. Any other acts deemed inappropriate by the Company.

Article 9: Changes to the Service

The Company may change, suspend, or terminate the Service at any time without reason. The Company shall not be liable for any damages incurred by Users due to such actions, except in cases of intentional misconduct or gross negligence.

Article 10: Usage Fees

Business members (including those applying for business membership) shall pay usage fees as follows:

  1. Business members shall pay usage fees to the Company or a designated payment collection agency. The Company may refuse the Service if the member fails to comply with the collection agency's terms.
  2. If fees remain unpaid after the due date, the Company may directly claim the unpaid amount from the member.
  3. Disputes with collection agencies shall be resolved at the member's expense and responsibility.
  4. Business members shall compensate the Company for any damages (including reasonable legal fees) arising from disputes with collection agencies.

Business membership may be suspended if payment is not confirmed.

Fees paid are non-refundable except in cases of intentional misconduct or gross negligence by the Company.

Subscriptions for business plans will automatically renew unless the member performs the designated cancellation procedure.

Article 11: Intellectual Property Rights

Intellectual property rights for all information (text, images, videos, etc.) provided in the Service belong to the Company or the respective right holders. Users may only use such materials within the scope explicitly permitted within the Service or for private use as allowed by the Copyright Act of Japan.

Copyrights for survey responses submitted by Users shall belong to the Company at the time of submission. Users shall not exercise moral rights of authorship regarding such content.

Copyrights for User Content belong to the User. However, the User is deemed to have granted the Company a non-exclusive, royalty-free, perpetual, and sublicensable license to use (reproduce, publish, transmit, distribute, translate, etc.) such content worldwide. Users shall not exercise moral rights against the Company or third parties designated by the Company.

Article 12: Compensation for Damages

The Company makes no guarantees regarding the usefulness, accuracy, legality, or non-infringement of content, and shall not be liable for damages except in cases of intentional misconduct or gross negligence.

The Company's liability for damages shall be limited to direct and ordinary damages actually incurred by the User, except in cases of intentional misconduct or gross negligence.

Users shall resolve any disputes with third parties arising from their use of the Service at their own responsibility and expense.

Article 13: Disclaimer of Map Information

The Company does not guarantee the completeness, usefulness, accuracy, or timeliness of the map information used in the Service and is not liable for damages arising from map content except in cases of intentional misconduct or gross negligence.

Article 14: Disclaimer of GPS Accuracy

GPS functions depend on satellite signals and may be inaccurate or unavailable indoors, near skyscrapers, or high-voltage lines. Users acknowledge that significant errors may occur between the indicated location and the actual location.

Article 15: Suspension and Refusal of Use

The Company may, without prior notice, suspend accounts or cancel registration if a User:

  1. Violates these Terms.
  2. Engages in prohibited acts (Article 8).
  3. Has had their registration revoked in the past.
  4. Provided false information during application.
  5. Damages or risks damaging the Company's brand.
  6. Fails to pay usage fees (for business members).
  7. Is otherwise deemed unsuitable as a User.

Article 16: Deletion Authority

The Company may delete content or change its visibility regardless of legality if:

  1. Information depicting nudity (real or otherwise) is posted.
  2. Public institutions or experts point out violations of law or public order.
  3. A right holder claims that the content infringes on their rights.

Article 17: Handling of Violations

If you discover a violation of the Terms, please contact us via the inquiry page.

The Company may take measures such as issuing a cease and desist, deleting content, or banning access.

Users may not object to these measures.

Article 18: Governing Law and Jurisdiction

These Terms are governed by Japanese law.

Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.

Article 19: Exclusion of Anti-Social Forces

Users represent and warrant that they do not currently, and will not in the future, belong to anti-social forces (organized crime groups, etc.).

The Company may terminate the Service immediately if a User is found to belong to such forces, without liability for damages to the User.
